McDonald was found later that morning at the home of his former 49ers teammateJustin Smith. McDonald remainedat the Santa Clara County Jail as of Monday afternoon.It's po sible he can escape this latest encounter without a criminal record, just as he has managed before. But the NFL, with its supposed more "robust" personal conduct policy, would be foolish to let him again walk away. No matter the cause, no matter the excuse or the he-said-she-saids, his employer has seen enough to do now what it should have done long ago.The Bears released McDonald on Monday afternoon. He was not arrested, but the case remains open.Only then did the 49ers release McDonald, who sued his accuser for defamation of character.
